These Website Services Terms (“Terms”) govern services purchased from Daniel Matthews (“Provider”). “Client” means the person or business purchasing the services. By completing checkout, approving a proposal, signing an order form, or otherwise authorizing work, Client accepts these Terms.
1. Scope, pricing, and exclusions
The available base plans are:
- Plumbing Foundation: $1,000 website build plus $300 per month.
- Local Growth: $2,500 website build plus $1,000 per month.
- Market Leader: $5,000 website build plus $2,500 per month.
Plumbing Foundation includes a focused mobile-first website, baseline on-page and technical optimization, analytics and Search Console setup, hosting, maintenance, monitoring, reasonable small edits, and quarterly reporting. It does not include monthly content production, ongoing Google Business Profile management, multi-city campaigns, backlink campaigns, or paid advertising.
Local Growth adds deeper search and competitor research, stronger service and service-area architecture, conversion tracking where technically available, one managed primary Google Business Profile, monthly reporting, and up to 2 major SEO actions per month.
Market Leader adds deeper multi-market planning, expanded service and location architecture when justified, more advanced conversion and CRM attribution when available, management for up to 2 primary Google Business Profiles, ongoing conversion review, monthly reporting, quarterly strategy review, and up to 5 major SEO actions per month.
A major SEO action is one substantial, prioritized improvement such as a useful service or service-area page, major page rewrite, declining-page refresh, conversion improvement, internal-linking project, or a project page based on the Client's real work. Exact scope is confirmed in the applicable proposal or order details.
Services exclude guaranteed results, unlimited edits, paid advertising management, custom integrations, third-party fees, paid placements, sponsorships, digital PR, and labor-intensive off-site authority or link acquisition unless quoted separately. Additional locations and unusually large builds may also require a separate quote.
2. Payment, delivery, and revisions
The applicable build fee, payment schedule, recurring fee, and approved third-party costs are stated in the proposal or order details. The first recurring payment is due no later than launch unless otherwise stated. By providing a payment method through the agreed payment processor, Client authorizes recurring charges during the service term. Payments are non-refundable and not prorated except when required by law. Provider may suspend service after a failed payment remains unresolved for 7 days.
Client will provide requested content, photos, access, business details, CRM information, and approvals and confirms it may lawfully use the materials supplied. The project timeline begins after the required materials and access are received. The expected delivery schedule and included revision rounds are stated in the proposal or project plan. Time waiting for Client is excluded.
3. Monthly term and cancellation
All recurring services under Plumbing Foundation, Local Growth, and Market Leader are month-to-month after the website build. No plan requires an initial multi-month ongoing-service commitment.
Either party may cancel with at least 30 days’ written notice by email. Client cancellation notices must be sent to danielmatthews1143@gmail.com. A payment scheduled during the notice period remains due, service continues through the paid billing period, and prior payments are not refunded or prorated.
After service ends, hosting and monthly services stop, and the website may become unavailable unless Client arranges replacement hosting. Provider may suspend or terminate sooner for nonpayment, unlawful use, security risk, or an uncured material breach.
4. Domain, ownership, and handoff
Client keeps ownership and control of its domain and business assets. Provider may receive administrative or manager access needed to perform the Services but does not take ownership of those assets.
After cancellation, Provider will reasonably assist with the handoff of available website files and access after outstanding balances are paid and destination information is supplied. Client is responsible for registrar, migration, replacement-hosting, and third-party costs. Registrar locks, platform restrictions, and third-party delays are outside Provider’s control.
Client owns its supplied materials and Google Business Profile. Provider will remove manager access within a reasonable period after Client requests it or service ends. Provider retains reusable code, tools, systems, templates, and methods. After full payment, Client may use the completed website and Client-specific content; third-party materials remain subject to their licenses.
5. Results, liability, and general terms
Provider will perform the Services professionally but does not guarantee rankings, traffic, leads, sales, uninterrupted service, or error-free operation. Client is responsible for legal review of its claims, offers, privacy notices, and use of information received through the website.
To the extent permitted by law, neither party is liable for indirect, special, punitive, or consequential damages. Provider’s total liability will not exceed the fees Client paid Provider during the 3 months before the event giving rise to the claim.
Provider is an independent contractor. These Terms, together with any applicable written proposal or order details, govern the Services. Any change must be confirmed in writing by Provider and Client.
